These Terms of Service ("Terms") govern your access to and use of the Alimia mobile app and related services (collectively, the "Service") offered by Alimia ("we", "us"). By using the Service, you agree to these Terms.
The Alimia app is currently coming soon. We publish these Terms ahead of launch.
You must be able to form a binding contract in your jurisdiction and comply with any age restrictions that apply. If you are using Alimia on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
You agree not to misuse the Service. For example, you will not:
By using the Service, you represent that you are using it lawfully and in compliance with applicable laws. You represent that you will not submit false help requests or use the Service for any fraudulent or abusive purpose.
You may be able to submit content through the Service (e.g., messages, help request details, and updates). You retain ownership of your content, but you grant Alimia a limited license to host, store, process, and share that content as necessary to operate the Service and according to your settings (for example, to deliver a help request to people you select).
All rights, title, and interest in and to the Service, including its technology, design, and content (excluding user content), are owned by Alimia or its licensors.
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and share information.
If you purchase any subscription or paid feature through the Service, you agree to pay all fees associated with that purchase. All purchases are processed through Apple's in-app purchase system and subject to Apple's terms and policies.
The Service may contain links to third-party websites or integrate with third-party services. We are not responsible for the content or practices of third-party services.
The Service is provided "as is" and "as available." To the fullest extent permitted by law, Alimia disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Alimia will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Service.
We may suspend or terminate access to the Service if you violate these Terms or if we reasonably believe suspension is necessary to protect the Service, users, or the public.
Alimia is evolving. We may add, remove, or modify features at any time. We may also discontinue the Service, in whole or in part.
We may change these Terms from time to time. When we do, we will update the Effective Date at the top and provide notice in-app, by email, or on the website before changes take effect.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, USA, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Texas.
You and Alimia agree to resolve any claim, dispute, or controversy arising out of or relating to these Terms through binding arbitration in Texas, USA, except for small claims filed in local courts.
